1. General provisions
Please carefully read the following “Terms and Conditions”, before using our service and make sure you understand its content.
These “Terms and Conditions” represent a binding agreement between you and “Black Sea Arena Georgia” LLC, which governs the use of the website of “Black Sea Arena Georgia” LLC by you, the purchase of tickets and rules of conduct for the events organized at the “Black Sea Arena” Concert Hall by the “Black Sea Arena Georgia” LLC.
Please note that, making use of our website and receiving our services through it, means that you agree with these “Terms and Conditions”. If you continue to use www.bsa.ge or purchase any event ticket available on the website, that is considered as unconditional consent to these "Terms and Conditions".
2. Definition of terms
2.1. Website - www.bsa.ge - a website through which the customer orders and/or receives services offered by the Company;
2.2. “We”, the “Company” – “Black Sea Arena Georgia” (I/C 405158804), the company registered on the basis of Georgian legislation, the legal address of which is: Georgia, Ozurgeti Municipality, village Natanebi (Shekvetili);
2.3. The "Customer", "you" - the person who orders and/or receives services offered by the Company through the website;
2.4. "Event" - an event organized by the company at the “Black Sea Arena” Concert Hall for the attendance of which you can purchase the tickets through the web-site;
2.5. The “Agreement” - a set of these Terms and Conditions;
3. The statements and guarantees of customer
3.1. The customer states and guarantees, that:
3.1.1 has read this agreement, understands its content and the “Terms and Conditions” set forth in it, is acceptable to him/her;
3.1.2. He/she is a capable natural person at least 18 years old, who is fully aware of the content of revealing his/her own will and the legal consequences of such will;
3.1.3 While concluding agreement acts within the scope of reveal of his/her own free will and is not the object of misleading, violent, threatening and/or deception;
3.1.4. Will use the Website only for personal purposes, in order to receive the service/to purchase ticket. You are not allowed to use the website and the services provided through it for commercial purposes without the Company's consent;
3.1.5. At no stage of his/her use of the Website (registration, usage, the use the services offered by the company, purchase of tickets, reimbursement of received/to be received services, cancellation of registration) he/she does not violate local or international legislation, regulation or the rights of third persons.
4. Registration on the website
4.1.1 In order to receive/purchase ticket offered by the Company through the Website, the customer shall register on the Website, for which he/she must enter relevant information and agree to these Terms and Conditions;
4.1.2. The necessary information required for registration is: name, surname, email, phone number, access code specified by the customer himself/herself;
4.1.3. The customer himself/herself is responsible for the accuracy of the information specified at registration at any stage of the use of the Website. The Company accepts no responsibility for any harm, which is the result of specifying incorrect information by the customer.
4.1.4. The customer, himself/herself is responsible for the confidentiality of the access code specified during registration by the customer and for any actions carried out through it. The Company accepts no responsibility for any harm, which is the result of use of access codes of the customer by a third person.
5.1 After the registration, for the purpose of receiving the service/purchase ticket offered by the company the customer shall make authorization.
5.2 Authorization can be carried out with the data specified by the customer while registration or via social network account (facebook).
6. Purchasing a ticket through the website
6.1. Registered and authorized customers can purchase the event ticket on the website;
6.2 When purchasing the ticket through website, the price can be paid by Visa/MasterCard plastic cards;
6.3. In order to execute the transaction, the customer must follow the procedures proposed by the bank;
6.4. Upon successful completion of the transaction, the customer will be informed about the purchased ticket, which will be saved on the website and at the same time will be sent as a notification to the email address specified by the customer during registration;
6.5. Each authorized customer can purchase up to 10 tickets through the website;
6.6. Tickets sold through the website are non-refundable;
6.7. If an event is canceled, the ticket holder will be able to refund the ticket fee within 90 calendar days from the cancellation of the event, after 90 calendar days you won’t be entitled to refund. Take in tone that only the face value of the ticket is refundable. A refund will be made via bank transfer according to ticket holder’s banking details which used when purchasing the ticket. Ticket holders who purchased a ticket at the box office must apply via email and attach bank details.
6.8 In order to attend the event, the customer has to submit a printed ticket or his/her electronic version via mobile phone;
6.9 The QR code shall be clearly readable on the printed ticket or on its electronic version;
6.10. The customer has theright to bring a child under 6 years to the event without a ticket, without the request of allocating extra chair for child;
6.11. In case of corporate purchase of tickets, the customer shall contact the company at the following email: [email protected];
6.12. If you wish to purchase tickets for people with disabilities(wheelchair users), the customer shall contact the company at the following email: [email protected];
6.13 It is prohibited to sell the purchased ticket to third parties by any means;
6.14. The Company accepts no responsibility for the authenticity of tickets purchased from third persons;
6.15. The customer is obliged to keep a ticket until the event is finished
7. Rules of conduct at the event
7.1 At the event, the visitors will be allowed only if they present a relevant ticket and so-called "green passport". They also must pass a special check;
7.2 The customer will be allowed at the event, only after the relevant ticket is submitted and a special inspection is made;
7.3 The customer and his/her belongings are subject to the inspection in the concert hall area or/and before the entrance into the concert hall.
7.4 The Customer’s behavior at the event must be consistent with public norms and ethics, he/she shall be regardful, respect the Concert Hall environment, employees and service personnel, the rules set forth in this agreement, other customers, security rules and the property of the Concert Hall;
7.5 The behavior, which endangers the health/life or safety of the customer himself/herself or/and other persons, is prohibited in the Concert Hall area;
7.6. The customer shall obey the security officer's request and/or instructions;
7.7 The food and drink must not be consumed in the Concert Hall area unless the above mentioned has been purchased in the bars in the Concert Hall area;
7.8. It is forbidden to bring any kind of animal in the concert hall area;
7.9. Smoking is prohibited in the concert hall;
7.10. Bringing the following items are prohibited in the Concert Hall area:
7.10.1. Firearms and ammunition;
7.10.2. All kinds of cold weapons and sharp objects that can be used as cold weapons;
7.10.3. Fireworks and pyrotechnics, signaling missiles, torches; any explosives, detonators or any item containing them;
7.10.4. Easily flammable items, incendiary items, liquids and aerosols;
7.10.5. Flyers, brochures, raffle tickets and other promotional products;
7.10.6. Large bags (without relevant inspection);
7.10.7. Laser pens, laser targets, or similar concentrated irradiation devices;
7.10.8. Drones and other controlled flying things;
7.10.9. Professional Photo/Movie/Video Cameras;
7.10.10. High-frequency radio-electronic devices, without an appropriate permit;
7.10.11. Toxic substances and drugs;
7.10.13. Fluid containers, exceeding 500 ml (without relevant inspection);
7.10.14. All symbols that include Nazi or any other prohibited by the law, directed towards a discrimination or an insult of a country, a person, a certain group, a nationality, an ethnicity or social belongings.
7.10.15 In the event of a breach of the rules set forth in this Article, the Company reserves the right to require the Customer to leave the Concert Hall without reimbursement of the ticket price.
8. Store rooms
8.1 The Customer can use store rooms available in the adjacent area of the Concert Hall;
8.2. The Company accepts no responsibility for any harm resulting from the loss of items left in store rooms;
8.3. In case of loss of the key to the store room, the customer is obliged to contact the Information Center located in the concert hall area;
8.4. In case of losing the key to the store room, the customer will be fined in the amount of GEL 10 (ten).
9. Information Center
9.1 There is an Information Center in the Concert Hall area, to which the customer should address in case of any problems;
10. Intellectual Property
10.1 Each image, graphic, audio and video clip placed on the website, as their combination, as well as website design, software code and computer software are the property of the Company and are protected by local and international intellectual property legislation.
11. Personal Data and Privacy
11.1 For the registration on the web-site it is necessary to provide some kind of personal information to the company by which the customer can be identified and communicated with.
11.2. The information processed and protected by the Company includes, but is not limited to: First Name, Last Name, Phone Number and Email;
11.3. The Company collects, processes and protects personal data for the purpose of identifying the customer and sending statistical information, as well as the information about purchased ticket, upcoming events and special offers.
11.4 The company is entitled to transfer personal data of the customer to third persons hired by it, for the following purposes;
11.4.1 Service improvement;
11.4.2 The analysis of the service;
11.5. The Company confirms, that it uses all means to protect the personal information obtained and processed by it and will not use it contrary to the terms set forth in this agreement and the customer confirms that he/she is aware of the risks involved in exchanging information over the internet and that the company cannot be an absolute guarantor of the security of personal data.
11.6.Please note that when registering through a social network, if in the future the user decides to deactivate the social media account, it is necessary to notify the company so that the latter can delete his personal data from the database.
12. The validity of the Terms and Conditions
These Terms and Conditions, after entering into force, are valid until registration is cancelled by the customer.
13. Procedure for making changes to the contract
13.1. The Company reserves the right to make changes to this Agreement unilaterally without preliminary notice to the customers.
13.2 After making changes to this agreement in order to continue using the website, while authorization, the customer must again agree to the present Agreement.
14. Governing law
This Agreement is governed by and construed in accordance with the legislation of Georgia.
15. Dispute Resolution
15.1. Any disputes and/or disagreements arising out of or in relation with this agreement between the parties shall be settled through negotiation;
15.2. If the agreement is not reached, the dispute shall be settled by the court of Georgia according to the Georgian law;
